These Terms of Use govern access to Surge Adopt, a product of Sales-Surge B.V. They supplement the full Sales Surge General Terms and Conditions (https://www.sales-surge.io/terms/), which prevail in case of conflict.
1. Access
Surge Adopt is provided to authorised Sales Surge personnel and authorised client users only. Keep your credentials confidential; you are responsible for activity under your account.
2. Acceptable use
Use Surge Adopt solely for its intended purpose — driving Pipedrive adoption from within Pipedrive — and only with data you are lawfully entitled to process. Do not bypass authentication, access other users' or tenants' data, reverse engineer the service, or use it for unlawful or unsolicited communications.
3. Your data and connections
You are responsible for the lawfulness, accuracy and backup of the data and API tokens you connect, and for having a valid legal basis (Art. 6 GDPR).
4. Effort basis, no guarantee
Surge Adopt is provided on an effort basis (inspanningsverbintenis, Art. 7:401 Dutch Civil Code) with professional care, without warranty of a specific result. Automated operations depend on third-party APIs (e.g. Pipedrive) outside our control.
5. Intellectual property
All rights in Surge Adopt, its code, design and methodology remain with Sales-Surge B.V. You receive a limited, non-transferable right to use the tool for its intended purpose; you retain ownership of the data in your own systems.
6. Liability
Liability is limited as set out in the Sales Surge General Terms and Conditions. To the maximum extent permitted by Dutch law, Sales Surge is not liable for indirect or consequential damages, loss of or damage to data, or damages caused by third-party software/APIs or by data/instructions you provided.
7. Availability
Surge Adopt is offered "as is" and "as available"; we may change, suspend or discontinue it at any time.
8. Governing law
